TERMS AND CONDITIONS Once the Operators, as detailed in Clause 12 below, (hereinafter referred to as “the Operator”), confirm your booking, a contract is made between you and the Operator under the terms and conditions set out below. Your statutory rights are not affected. In a booking with more than one passenger the ‘lead passenger’ will be deemed to have accepted the terms and conditions on behalf of all passengers within the booking. The ‘lead passenger’ is the passenger who makes the booking on behalf of all passengers in a multi-passenger booking and is named in the ‘lead passenger’ field within the booking. Within these Booking Conditions, “you” and “your” means all persons named on the booking (including anyone who is added at a later date).

1. BOOKING / ACCEPTANCE

1.1 The Operator accepts a booking on the understanding that a deposit or full payment has been collected and held either by the Operator directly or by an authorised Travel Agent on the Operator’s behalf. Bookings made via the Operators’ own websites are considered as made with the Operator directly.

1.2 On confirmation of your booking, subject to availability and at the Operator’s discretion, the Operator will reserve your place(s) on your selected product(s) “tour(s)”. It is your (or on bookings involving more than one person, the lead passenger’s) responsibility, as the customer, to check the accuracy of your booking including your travel dates. A contract is only made between you and the Operator upon your booking being confirmed and accepted through written communication thereof to either you or your authorised Travel Agent (hereinafter referred to as “confirmation”).

1.3 On confirmation of your booking, a Booking Statement confirming ‘Full Payment’ and an e-ticket will be sent to either you or your Travel Agent for fully paid bookings. A Booking Statement indicating the amount paid and an e-ticket will be sent, for bookings where only a deposit or lesser amount has been paid.

1.4 In order to reserve your tour: 1.4a) Tours costing 200 GBP / 300 EUR / 400 USD / 400 CAD / 400 AUD / 400 NZD / 2000 ZAR or less: full payment must be made at time of booking (except as outlined within clause 1.4c) 1.4b) Tours costing more than 200 GBP / 300 EUR / 400 USD / 400 CAD / 400 AUD / 400 NZD / 2000 ZAR: a non-refundable deposit of 50 GBP / 75 EUR / 100 USD / 100 CAD / 200 AUD / 200 NZD / 1000 ZAR, per person per tour is required (except as outlined within clause 1.4c). 1.4d) For bookings made using the Adventure Planner tool – for any network travel and / or network accommodation customized packages within these bookings: a non-refundable 15% deposit per person per trip is owed. In the event that an Adventure Planner booking additionally includes other tours, additional deposits per person per trip will be owed as outlined within clauses 1.4a and 1.4b. If the booking is made within 45 days of the nominated departure date (or prior to 6th March 2020 for Ultra Sail) the full amount payable must be made at the time of booking. This payment is in addition to any deposit required by your Travel Agent. The deposit is accepted as a first instalment of the total tour price by the Operator only once the booking has been confirmed in writing by the Operator or your travel agent. 1.4c) The outstanding balance of the tour price must be paid by no later than 45 days prior to the scheduled, nominated or confirmed tour departure date or the payment date specified in any promotion (or prior to 6th March 2020 for Ultra Sail), which shall be by the due date stated on the confirmation issued to you. Whilst every endeavour will be made to remind you of the payment due dates, it is your responsibility to make this payment in full by the due date. If payment is not made to the Operator or to your authorised Travel Agent (for Agent bookings) by the due date, the Operator will assume that you have cancelled your tour and cancellation charges in accordance with clause 3 below will be levied by the Operator 1.4e) Booking Statements confirming ‘Full Payment’ will not be issued until full payment has been received by the Operator or authorised Travel Agent. 1.4f) Deposit option is not available on Haggis Up Helly Aa Viking Fire Festival and Tomorrowland & Unlimited Hop on Hop off pass Package where full payment is required at time of booking.

1.5 In the case of bookings made within 45 days of tour departure (or after 6th March 2020 for Ultra Sail), the full cost of the tour will be payable immediately at time of booking.

1.6 The Operator reserves the right to cancel the booking and apply cancellation charges should full payment not be received within the above specified periods.

1.7 Haggis and Shamrocker Adventures only - If you wish to book to travel at student prices, you must have an ISIC, ITC or ISE student ID card or a Student Flights ID Card, valid at time of and for the duration of your travels with the Operator. Photocopies or confirmations of purchase will not be accepted.

1.8 Asia Unlimited Pass – this pass permits travel on every Busabout Asia trip Itinerary once within a 3 month period after the nominated start date on booking. You must confirm your individual trip departure dates within this pass a minimum of 45 days prior to departure.

2. TRAVELLING

2.1 The Operator’s e-tickets / Booking Statements confirming ‘Full Payment’ are not transferable. Your e-ticket / Booking Statement indicating that full payment has been made must be produced at any time at the Operator’s request. You will also be required to produce your valid passport, and (for Haggis and Shamrocker Adventures) the valid student ID card used when booking for travel at student prices (see section 1.7 and 5.13), each time you travel. A valid passport is required as proof of identification for all tours.

2.2 With the exception of Busabout, which has a maximum combined baggage weight limit of 20kg, baggage is restricted to one reasonable sized suitcase or backpack and one small carry-on bag per passenger (maximum combined weight 15kg). Carry-on bags must not weigh more than 10kg. Baggage in excess of these limits may not be carried.

2.3 It is your responsibility to check-in with the Operator not less than 15 minutes prior to the specified departure time. The Operator will not be liable for any service that arrives later than its specified time in the event that it departed within 3 hours of it’s scheduled departure, even if as a result you miss a connecting service. The Operator will use its best efforts to ensure that departure and return times are met.

3.CANCELLATION & CHANGES

3.1 Cancellation of your booking must be in writing to either the Operator (for direct or website bookings) or the authorised Agent through which your booking was made. If your booking was made through an authorised Agent, all amendments and cancellations must be made directly through the Agent and not with the Operator (the Agent may also levy cancellation charges in addition to those noted below - please check with the Agent at time of booking). When written notification has been received by the Operator, a fee will be levied to cover the costs incurred. The amount of the cancellation fee will be dependent on the number of days prior to the departure date of the tour (not including the day of departure or the day of notification).

3.2 Flex-Deposit: If you need to cancel for whatever reason, where written confirmation is received from you or your authorized Agent with minimum 45 days notice prior to your confirmed or nominated departure date (or prior to 6th March 2020 for Ultra Sail), your deposit value will remain secure with the Operator or your authorized agent (as originally booked) until you are ready to use it against another trip. Flex-deposits can only be credited to or from trips that qualify for a deposit as outlined within clause 1.4. One deposit amount can be credited per trip. Deposits cannot be combined or applied to existing bookings. No refund of the deposit will be applicable. Where the new trip departure is within the 2020 operating season (including all scheduled departures until March 2021), this must be confirmed in writing to the Operator minimum 45 days prior to the new departure date. One date change per person per tour is permitted without incurring an administration fee from the Operator. Any additional date and / or tour changes will incur an administration fee of 25 GBP / 30 EUR / 45 USD / 45 CAD / 45 AUD / 45 NZD / 400 ZAR per person per tour. For travel during the 2021 Operating season (including all scheduled departures until March 2022), the new departure date must be confirmed by 31st December 2020 and will be subject to the confirmed brochure prices and booking terms and conditions of the 2021 Operating season. Tour changes to one of higher value or seasonality will require the difference in price to be paid. It is your responsibility to notify the Operator in writing of your new nominated departure date.  If the Operator has not received notification prior to the minimum notice period given the Operator will assume that you have cancelled your tour, you no longer wish to travel and your deposit will be forfeited. All changes are subject to availability. The 15% Adventure Planner network travel and accommodation deposits as outlined within clause 1.4c) do not qualify for Flex-Deposit.

3.3 Cancellation of individual passengers from a multiple booking where a group discount applies (e.g. ‘Mates’ Rates’ discount) will mean that the discount applied at the time of booking will be forfeited, due to the qualifying criteria no longer being met. If the cancellation results in the qualifying criteria no longer being met, then the total price payable for the remaining passengers on the booking will be adjusted, and any forfeited discount will be reclaimed through deduction in calculating any refund due to the cancelling passengers.

The below cancellation fees are levied from periods of notice given prior to confirmed / nominated departure date as a % of the total trip fare.

3.4 Upgrades and Add Ons do not qualify for a deposit payment and attract a 0% fee if cancelled with their connected product outside 45 days. A limited number of upgrades and add-ons may be available with respect to the availability of their connected product.

3.5 Adventure Planner cancellations and changes – any associated cancellation fees and conditions are based on the conditions of the individual component trip concerned as outlined within clause 3.

3.6 For trips that do not qualify for a deposit option when booked more than 45 days prior to the confirmed / nominated departure date, any cancellation outside 45 days will levy the same fee as per cancellations from 45 days until the full fee threshold.

3.7 Busabout Adventures include the following trips: Iberian Adventures, Italian Adventure, Ibiza Blast, Croatia Sailing (Island Hopper & One-Way Sail), Croatia Adventure, Greek Island Flexi-Hopper, Greek Island Hopper, Big Fat Greek Adventure, Greek Odyssey, Morocco Adventures, Turkey Sail, Turkey Adventures, Scandinavia and Baltic Adventures, Balkan Adventures, Busabout Winter Adventures (Ultimate, Eastern, Southern and Northern), Small Group Adventures (Northern Highlights, Eastern Wanderer, Roman Footprints, La Dolce Vita), All Asia Adventures, all USA & Canada Adventures and all associated tour add-ons.  and all associated tour add-ons.

3.8 Greek Island Flexi-Hopper: No itinerary changes are permitted within 15 full days of departure date.

3.9 Festivals & Events include Oktoberfest (Camping and Hostel trips), La Tomatina (Hotel and Daytrips), Sziget Festival, Ultra Hostel, Lollapalooza Festival, Halloween Trek, Busabout Festive Treks (Eastern and Alpine), Shamrocker St Patrick’s Day, Haggis Passion Projects, Christmas, Hogmanay and Up Helly Aa Viking Fire Festival trips, and all associated tour add-ons.

3.10 Private Group / Bespoke Tour - specific cancellation fees apply to each Tour, the Operator will inform you of these prior to payment. A non-refundable deposit will be required at time of booking to cover any accommodation, third party supplier, meal and attraction costs. Where bookings include entrance fees to attractions, accommodation, involve accommodation upgrades or specific accommodation requests any cancellation fees incurred by the Operator will be passed on to you in addition to the standard Private Group / Group Tours refund policy.

3.11 Any changes of departure date or tour within the deposit threshold but prior to the full fee threshold (as defined within clause 3) will incur an administration fee of 25 GBP / 30 EUR / 45 USD / 45 CAD / 45 AUD / 45 NZD / 400 ZAR, per person per tour, where the new departure date / tour must be immediately nominated. These changes may result in the loss of any special discounts applied to the originally booked Tours and are in addition to any fees that may be levied by your Travel Agent. No changes are permitted to Tomorrowland bookings at any stage.

3.12 Any changes to individual Adventure Planner accommodation and / or travel segments will incur an amendment fee of 50 GBP / 75 EUR / 100 USD / 100 CAD / 100 AUD / 100 NZD / 1000 ZAR per person per change. Any amendments to Adventure Planner accommodation are based on live pricing and availability at time of amendment and may be subject to additional fees based on this.

3.13 If the reason for your cancellation is covered under your insurance policy, you may be able to make a claim under that policy.

3.14 Name changes are permitted provided a minimum 30 day notice period from the nominated departure date is given in writing with full passenger details and will incur an administration fee of 25 GBP / 30 EUR / 45 USD / 45 CAD / 45 AUD / 45 NZD / 400 ZAR, per person per tour. Within 30 days of the nominated departure date no name changes are permitted. No name changes are permitted on Tomorrowland & Unlimited Hop on Hop off pass Package bookings at any stage.

3.15 – Asia Unlimited pass – Any date changes of individual trips within the Asia Unlimited pass are permitted until 15 days from departure of the individual trip stated at an administration fee of 25 GBP / 30 EUR / 45 USD / 45 CAD / 45 AUD / 45 NZD / 400 ZAR per person per tour, subject to availability. No date changes are permitted within 15 days of each individual trip. Date changes are only permitted to departure dates within 3 months of the nominated pass start date. For any full cancellation, name change or change to the nominated start date of the Asia Unlimited pass, the pass is considered 1 product with conditions outlined within clause 3. No refunds are permitted based on incomplete use of the pass.

3.16 If you have purchased Busabout Gold Seal Protection (South Africa) you may be entitled to a further refund in the event of cancellation. Restrictions may apply – see Busabout.com for full terms and conditions.

4.BUSABOUT EUROPE HOP-ON HOP-OFF PASSES – SPECIFIC CONDITIONS

4.1 A ‘network’ is defined as a regularly repeating and continuous sequence of travel services between a pre-set group of destinations or stops. A ‘sector’ is defined as any travel between two stops on a network in one coach day, a ‘coach day’ is made up of one or more sectors. A pre-set number of stops are grouped together to form a ‘pass’ on a given network.  A ‘Pass’ is defined as a collection of stops anywhere on a given network, which can be either a ‘Stop Pass’ which allows a pre-determined number of ‘coach days’ to be booked anywhere on a given network for travel on any dates within the 2020 operating season, or a ‘Timed Pass’ which allows for ‘coach days’ to be booked for travel dates within a limited and pre-determined continuous period of time anywhere on a given network, or an ‘Unlimited Pass’ which allows an unlimited number of ‘coach days’ to be booked anywhere on a given network for travel on any dates within the 2020 operating season. The available pass types will vary depending on the sales and / or operating region.

4.2 Your first date of travel must be nominated and confirmed at the time of purchase.

4.3 Departure dates for the Pass(es) can be changed at no charge up to 14 days prior to the confirmed first date of departure, subject to availability.

4.4 Confirmed seat reservations can be made for any sector at the time of booking or at any time up until 24 hours prior to each scheduled departure date, subject to availability. Sector bookings may be changed without charge, subject to availability.

4.5 Individual sectors may only be travelled once on a confirmed seat reservation basis, if you wish to travel a particular sector more than once this can only be done on a standby basis.

4.6 It is strongly recommended that you book your sectors as far in advance as possible to ensure seat availability on your desired travel plan. The Operator cannot be held responsible if particular sectors are not available because coaches are already fully booked.

4.7 If you do not wish to travel any pre-booked sectors you must cancel them at least 24 hours in advance. If you fail to do so you will only be allowed to travel that same sector at a later date on a ‘standby’ basis. ‘Standby basis’ means that all pre-booked passengers on the said sector take priority on seating. Only if there is a spare seat on the coach available, may it be offered to you.

4.8 Travel must take place within the 2020 operating periods as stated.

4.9 The Busabout e-ticket / Booking Statement confirming ‘Full Payment’ must be presented to the Busabout Representative on your first day of departure. The Operator may not allow you to travel if you do not have a valid Booking Statement confirming ‘Full Payment’ and your valid passport.

4.10 Please check you have the correct e-ticket/ tickets, as mistakes cannot be rectified later.

4.11 You are responsible for making all accommodation arrangements – Booking a “Hop-on Hop-off” pass will allow you access to “MyTrip”, the Operator’s online planning tool, through a unique client reference number provided by the Operator using which you are able to book your coach sectors and accommodation within the My Trip itinerary planner. All accommodation reservations made within the MyTrip itinerary planner are considered a direct agreement between yourself and the accommodation service provider bound by their terms and conditions.

4.12 The Operator will offer a Product Credit up to the value of 5% of the total accommodation bookings made at Busabout 2020 Europe Hop-on Hop-off preferred partner pick up and drop off point accommodations and using MyTrip. This credit may be only applied to new trip bookings with the Operator for travel during the 2021 season. This product credit has no monetary value. This product can only be redeemed once, credited to the booking passenger or gifted to a friend on completion of the 2020 operating season. The Operator will endeavor to advise all passengers by email of the 2020 BedCred accrued on completion of the 2020 operating season.

5.YOUR RESPONSIBILITIES

5.1 The tour/tour products offered are forms of transportation. For this reason the Operators’ representatives cannot offer constant special attention or assistance should you have any disability requiring such attention.

5.2 All programs offered have been designed for passengers aged 18 years and over with the style and operation specifically designed for young independent travellers. This fact should be recognised when you book. Passengers are primarily in the 18-45 year age group.

5.3 Busabout permits the travel of persons aged 12 – 17 (“Young Adult/s”) on our Hop-on Hop-off Network in both Europe or the USA. Travel is only permitted using either a ‘Hop-on Hop-off Travel Pass’ or as part of the Busabout travel network within an ‘Adventure Planner’ booking (Hotel accommodation only). Each Young Adult travelling must be accompanied by their Parent or Guardian travelling on the booking who must be present for the duration of the booking, will remain fully and solely responsible for the Young Adult during their travels, and shall not hold Busabout liable in any way for their care, beyond the normal services offered to travelers over the age of 18. You acknowledge that certain accommodations offered or recommended by Busabout have a policy of only accepting guests aged over the age of 18. There may be excursions and experiences offered by Busabout that will be unsuitable for Young Adults. Please refer to the terms and conditions of these individual independent providers for further details. For all other programs, all Passengers must be aged 18 years or over on date of travel commencing. The Operator may, at its absolute discretion at time of booking, and in exceptional circumstances, give confirmation of acceptance of a person outside this age restriction. There is no upper age restriction.

5.4 PASSENGERS WITH DISABILITIES are welcome on trips, provided that they are accompanied by a companion capable and in agreement of providing all necessary assistance and do not require special assistance from the Operator’s personnel. The Operator will not be responsible for the failure of this person to provide these services. Any medical or physical condition requiring third party attention or treatment must be advised in writing to our Reservations Team at the time the booking is made. It is your responsibility to see to it that your letter is acknowledged with the booking confirmation. The Operator cannot guarantee travel in the absence of such an acknowledgement. Similarly, if you wish to make a special request about any matter concerning your travel or accommodation you must do so at the time of booking. Again, it is your responsibility to produce an acknowledgement from our Reservations Team at the time of travel. We will try to pass on any reasonable requests to the relevant suppliers but we cannot guarantee that your requests will be met. The fact that a special request has been noted on your confirmation invoice or on any other acknowledgement is not confirmation that the request will be met. Failure to meet any special requests will not be a breach of contract on the part of the Operator unless the request has been specifically acknowledged and confirmed as accepted by our Reservations Team. The Operator reserves the right to refuse to carry anyone if it is felt that the individual cannot cope with the requirements of the tour and who may require services and facilities that the Operator cannot guarantee will be available. The nature of the tours means that not every type of disability can be accommodated despite reasonable endeavours of the Operator. Most tours involve getting on and off coaches, trains, boats or ferries, sitting for long periods on coaches without toilet facilities, walking and other physical activities which may involve steps and stairs at sightseeing stops, visitor attractions and accommodation units. Coaches are not adapted to carry wheelchairs and do not have ramps, lifts or low floor access. Collapsible wheelchairs can generally be carried in the luggage hold but you must check in advance with our Reservations Team to ensure that this is the case for your tour. The Operator cannot carry any motorised wheelchairs under any circumstances. You agree not to hold the Operator responsible for any decision made by them or by any service provider to refuse to carry you, provide any facilities or accommodation to you, or to provide any service to you in the absence of written acknowledgement and acceptance of your special request or of your disability from our Reservations Team. Please note that 100% cancellation charges would apply in these circumstances.

5.5 It is your responsibility to have a valid passport and all necessary visas / visa waivers, permits and certificates on your person for your selected itinerary, to have all necessary vaccinations and to comply with applicable laws. All passport holders should check with your Travel Agent or Consulate Service for information regarding necessary travel documentation. Schengen Visas – it is your responsibility to have your passport stamped on entry to the European Union. The Operator will not allow you to travel if you do not have a valid visa for your destination. The Operator will not allow you to travel without a valid passport. The Travel Industry Council of Ontario (Canada) requires the Operator to state the Visa requirements for Canadian Passport Holders across all Operating destinations and state that all guests must be in possession of a machine-readable passport valid for 6 months after their trip return date along with applicable visas. As of 1st October 2019, Canadian Passport holders require visas for Turkey, Vietnam, Cambodia and Laos prior to departing their country of origin. Entry to another country may be refused even if the required information and documentation are complete.

5.6 You agree to comply with the authority of the Operator’s representative and the laws and regulations of the countries visited, including customs and foreign exchange restrictions. If you do not do so, you may, at the discretion of the Operator’s representative, be asked to leave the tour. No refunds will be issued in such circumstances.

5.7 You agree that the Operators’ representatives may take photographs and video recordings of you while you are a passenger. These may be used in the Operator’s brochures and/or advertising and publicity material (including social media) without obtaining any further consent or payment in respect of such photographs and/or films.

5.8 You agree that the Operator may use any text written in comments books, recorded in customer surveys or input to online forums, in brochures, websites and/or advertising and publicity material without obtaining any further consent or payment in respect of comments.

5.9 There may be times when the Operator’s personnel and/or representatives have to make a decision in the interests of safety. It is a condition of booking that you comply with the authority and decisions of the appointed representative of the Operator. If you do not comply with the said representative or are not compatible with the general enjoyment and well-being of members of the tour, the Operator reserves the right to refuse to allow you to continue the tour. In such a case the Operator will not be liable for any refund, compensation or any additional costs incurred by you. The Operator cannot accept liability for the behaviour of others on your tour nor if any facilities are curtailed as a result of their actions.

5.10 The Operators do not tolerate any form of abuse, verbal or otherwise, of its personnel. Any person abusing or threatening the Operator’s personnel or associated representatives will automatically forfeit their right to onward travel and any associated refund.

5.11 You are responsible for looking after your personal belongings whilst travelling. The Operator cannot be held responsible for any personal belongings left behind or damaged on any tour irrespective of the circumstances.

5.12 It is the responsibility of the individual passenger and authorised Travel Agent on the passenger’s behalf, to check the accuracy of dates booked upon receipt of their Booking Statement confirming ‘Full Payment’.

5.13 If you paid a Student price on booking (Haggis and Shamrocker Adventures only), you will be required to prove this entitlement at check-in for each departure by exhibiting a valid ISIC, ISE or ITIC student card or Student Flights ID Card. Should you not be able to do this, you will be charged the difference between the full tour price and the student discounted price in addition to an administration fee of 25 GBP / 30 EUR.

5.15 The Operator has a zero tolerance policy on possession of illegal drugs or substances. Any passenger deemed to have breached this condition by the Operator will automatically forfeit their right to onward travel and any associated refund.

5.16 The Operators operates a No Smoking Policy on all their vehicles and properties.

5.17 By booking a trip that includes Multi-share accommodation, you acknowledge that the Operator and / or its representatives is unable to confirm same gender room allocation.

5.18 By booking a trip you acknowledge that standards of accommodation, utilities, and services in addition to general living standards and practices at the destination may be different from those of your country of origin. Note accommodation room sizes, standards, facilities and services provided may vary from country to country and region to region and are often local in style.

5.19 By booking a Tomorrowland & Unlimited Hop On Hop off pass Package you agree that each passenger will additionally acknowledge and agree to the General Rules & Conditions of Tomorrowland as outlined here. Additional information from each passenger will be required at time of booking – please ensure this is completed as you may forfeit your right to travel should these details not be completed and accurate.

6. LOCAL TOURS & EXCURSIONS

6.1 You may have the opportunity to purchase local tours or excursions from the Guides / On-Board Guides/Check-in Staff/the Operators website/ App. These local tours and excursions are run by local Operators and you will be subject to their terms and conditions.

6.2 Local tours and excursions purchased via Guides/On-Board Guides/Check in Staff / the Operator’s website / App are nonrefundable. It is your responsibility to meet the tour at the designated departure point and time. Travel on local tours and excursions will only be permitted on presentation of the official Guides/On-Board Guides/ Check in Staff / Operators website / App issued voucher or E Voucher to the named local Operator.

6.3 Local tour and Excursion vouchers that are lost or stolen cannot be replaced.

7. INSURANCE

7.1 There is no travel insurance cover included in the price of any pass(es), ticket, tour, trip or product represented in this brochure.

7.2 The Operator requires that you take out comprehensive insurance cover for cancellation, medical expenses, personal accident, personal baggage, money and public liability before you travel. You may also wish to indemnify the Operator against all third-party claims, actions, damages and remedies that may be brought against the Operator in respect of your travel needs/requirements. The Operator may require you to provide details of your insurance as a condition of travel.

8. CHANGES BY THE OPERATOR

8.1 Prices of our 2020 season programs are based on costs and exchange rates at between June and August 2019 (product dependent). Should these costs change it may be necessary to make a surcharge on the price of your tour. Should the total tour price increase by more than 7% you will have the right to cancel within 7 days of notification without penalty.

8.2 No surcharge in respect of costs or currency fluctuations will be made once payment of the deposit for your tour has been received. This guarantee excludes fuel surcharges and does not apply to any taxes, charges or levies imposed by any Government or their Agencies. In exchange for these guarantees, no refund will be made if costs are reduced. The surcharge will only be made where the increase in cost will affect the price of the tour by more than 2%.

8.3 The Operator reserves the right to vary, modify or cancel any itinerary, either part or wholly. If this is necessary, they will substitute alternative arrangements of comparable value at no extra cost, or provide a full or partial refund if essential elements of the package, other than price, are changed significantly.

8.4 If access to any country or area is prohibited for reasons of force majeure (i.e. circumstances such as political unrest, war or threat of war, riots, civil strife, closure of airports or ports, industrial disputes, terrorist activity, natural and nuclear disasters, fire, epidemic or health risk, Acts of God, adverse weather conditions or other similar events beyond the Operator’s control) the Operator reserves the right to amend or alter the product, or fully or partially withdraw the program, based on the official advise of the respective travel authorities. If prior to travel, you wish to cancel your package as result of these exceptional circumstances and / or the Operator is unable to provide the agreed services as a direct result, you are entitled to cancellation without charges.

8.5 The Operator reserves the right to alter or substitute the type of vehicle mentioned in the brochure or websites.

8.6 Under no circumstances can the Operators be held responsible for any delay, deviation or cancellation due to weather conditions, nor can any tour be cancelled or amended by you at any time on the basis of weather conditions.

9. DISPUTE PROCEDURES

9.1 If you have a complaint in respect of any Operator, you should inform the Operator’s Representative at the time. Any complaint that cannot be resolved by the Operator’s Representative should be submitted in writing within 60 days of the incident to The Customer Services Manager, Busabout, Haggis, Shamrocker, Travel House, Rue Du Manoir, St. Peter Port, Guernsey, GY1 2JH, Channel Islands so that your complaint can be passed to and then investigated by the Operator. Guest claims not submitted and received within this time shall be deemed to be waived and barred.

9.2 The contract and all matters arising in respect hereof shall be subject to Guernsey Law unless the Operator agrees otherwise in writing.

9.3 If any provision of this contract is held invalid or unenforceable by any court of competent jurisdiction, that provision shall be deemed to be re-written to give effect to the same purpose within the permitted limits of the law. The validity and enforceability of the other provisions shall not be affected.

9.4 In any legal action, arbitration, or other proceeding to enforce, interpret or construe the terms of this agreement or concerning any grievance relating to the booking, the prevailing party shall be entitled to recover its reasonable legal fees and expenses on a solicitor/client basis.

10. CONTRACTING PARTIES

10.1 The booking conditions detailed herein contain the entire contract between you and the Operator. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be varied by a duly authorised officer or Director of the Operator in writing.

10.2 Your contract is with the Operator. At any time, and at the Operator’s complete discretion, the Operator may nominate to you in writing any other company or person to have the benefit of some or all of those provisions of this contract, which the Operator may then specify, as if you had agreed the provisions concerned directly with that company or person in the first place as well as agreeing them with the Operator. The Operator may at its complete discretion assign all or any rights and liabilities arising under or by virtue of this or any other contract with you.

10.3 All bookings with other Operators and service providers are subject to their terms and conditions and limitations of liability. Please note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Whilst the Operator cannot accept any responsibility for any loss as a result of such actions or as a result of any act or omission of any such third parties, the Operator will give reasonable assistance in helping to resolve any reasonable dispute.

10.4 Many accommodation arrangements referred to in this brochure are provided independently and directly by third party providers (unless stated otherwise). Any such contracts undertaken are made directly between you and the third party accommodation provider. They are subject to the terms and conditions, and limitations of liability, imposed by the individual accommodation provider. All such arrangements are made independently of the Operator, regardless of any help and assistance, which the Operator may provide in securing such arrangements.

10.5 Please note that no airline or carrier depicted or recommended in this brochure by virtue of their endorsement of this brochure represents themselves either as contracting with any legal relationship with any such purchaser.

10.6 Every effort is made to ensure brochure accuracy at the time of going to print, however the Operator cannot be held responsible for printing and typographical errors, or errors arising from unforeseen circumstances.

11. VALIDITY
The programs, products and tours advertised in this brochure are valid from the operating season pertaining to each Operator as specified in this brochure and the Operator’s website, unless stated to the contrary. These Terms and Conditions supersede all previous Terms and Conditions issued and are valid for all reservations made on or after 1 June 2019, until replaced.

12. OPERATING COMPANIES

14.1a) The Busabout Hop-on Hop-off, Busabout Adventures and Busabout Festivals services advertised in this brochure are operated by Busabout Operations Ltd, The Travel House, Rue Du Manoir, St. Peter Port, Guernsey, GY1 2JH, Channel Islands. 13. DATA PROTECTION STATEMENTPlease be assured that we have measures in place to protect the personal booking information held by us. This information will be passed on to the principal and to the relevant suppliers of your travel arrangements. The information may also be provided to public authorities such as customs or immigration if required by them, or as required by law. Certain information may also be passed on to security or credit checking companies. We will only pass your information on to persons responsible for your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements.
